Innovacion 14 - What is known to date

After the submission of a series of requests for information and the submission of a series of questions in the last council meeting (see my previous post) the town council has released and published a series of documents relating to Innovacion 14.

Having reviewed the document with the help and assistance of experts, we now know the following about the implementation of Innovacion 14.

Innovacion 14:
There is a separate plan, budget and timeline for the urbanisation of each asentamiento  within Innovacion 14. The town hall has now published, or released, the first level of planning for 5 out of 19 of the asentamientos included within Innovacion 14.
The planning for unpublished and/or unreleased areas is incomplete or not yet started.
The published areas are highlighted in bold below.

ESTIMATED COSTS AND TIMELINES
The total estimated cost to execute 5 of the 19 plans required to implement Innovacion 14 is â,¬1,670,869
This cost estimate breaks down as follows.

The costs include the preparation of the PERI document, the Reparcelization Project, the Urbanisation Project, Project Management Costs and overheads and the actual urbanisation works themselves.

The documents estimate that it will take 6 months to execute the urbanisation works for each project irrespective of the size of the budget or the amount of work involved.

Who Pays??
There are two lists of names within each PERI document
-        Those registered as title holders according to the catastral
-        Those who names appear as owning a property in these areas within the Inspection Plan dating from around 2009 which documented all properties on suelo no urbanizable in Arboleas.

Due to issues of data protection, this part of the PERI information was removed from the information published on the town hall website.

In the normal course of an urbanisation process the costs will be distributed to those named according to a formula that has yet to be published. Therefore, it is not possible to say how the costs will be distributed to individuals at this time.

What happens if some people cannot or will not pay?
The town hall will fund the work with contributions from those listed and if that funding is not forthcoming, they will place a charge on the land and they also have the legal power to sue for non-payment.

In the meeting in Fines the Director General for Planning in Andalusia was asked what the governments position would be if the town halls used public funds to pay for the urbanisation works. He said that this was currently an open question but he did say that it might be possible if the works were deemed to be in the public interests.

Commentary
The town hall has an annual income of around 3 million euros. This is public money with which it funds all of its projects and activities in the general interest.  We now know that 5 of the 19 projects required to execute Innovacion 14 have an ESTIMATED cost of 1.6 million euros.  Therefore, where the money comes from to fund Innovacion 14 remains a key issue.

For now, it is important to make sure that those executing this plan know that you are an interested party so that you have the legal right to be informed as the project progresses and will eventually benefit from it. By benefit from it I mean that your house will be registered in your name.  As I understand it you should receive a letter from the town hall informing you that you are a party to one of the 5 PERIs published to date. If you have not received a letter, check with the town hall.
