Community President rules not allowed to rent apartment for less than 2 months

I'd recommend speaking to the management Co in the first instance as it will cost nothing - that's the Co you pay the community fee's to.
The AGM is usually poorly attended physically but you can stipulate you want to vote and drum up enough support/votes so that hopefully things stay as they are?
looking deeper, have problems occurred with renters? If yes, is there a simpler solution?

We bought our apartment which cost more than our budget, the Estate Agent suggested we rent it out in July and August which would cover the community fees for the year, pay the insurance, IBI and basura.   The holiday makers who have used our apartment have been very respectful of our furniture and décor etc we have not had any complaints only positive feedback and bookings for next year, There have been no reports of noisy behavior either and the rentals have really taken off the pressure  for us, and we can relax when we come for our holiday.  NOW the community President is planning to forbid all rentals for less than a 2 months duration, we will not be able to afford our apartment and will have to sell it if he gets his way.   Many of this mans rules are given the go ahead because owners who do not live in Spain use a proxy vote, but many of us are very suspicious of these votes, on one occasion we spotted our name beside a person we did not know who claimed to have voted on our behalf when we questioned it, they said it was a typing error! without this rental money we cannot keep the apartment, we are very very worried, does anyone know if this man can do this.  Many of our neighbours are worried too as the agent told them to rent to help pay the running costs like us they bought thinking the 2 month rental would help with the running costs, can anyone help on this please?

you need a copy of your community laws & regulations and then a good Administration law firm .

Surely this would have to be debated at an ATM and then voted on before it could be implemented.  Then a majority vote would have to be given to pass it.  I agree that you need to check with your solicitor what it states in your contract ref renting at the time of purchase.

I wouldn't have thought that the President of the community could decide this alone. Do you have a management company? Possibly speak to your solicitor to get clarification on what can and cannot be done.
