You're referring just to CITES related laws within Europe there. However... there are other, regional, restrictions that apply. Further, different countries do interpret CITES laws somewhat differently.   There are Spanish regional laws that - for example - currently prohibit even the transport through Catalonia of Testudo hermanni (even if chipped and with certificates). So you cannot rely merely on the CITES regulations. Another one few people know about is the rule in Andalucia prohibiting all reptiles in captivity over a certain weight... widely ignored, but still the law here, and severe penalties theoretically possible.

You can buy any tortoise as long as it has the correct paper work I would not buy from any pet shop as none of them know or do not bother about what is needed.I have been to several and have been told that it is no problem, a fine of up to ten thousand pounds is a problem.You can buy and sell any appendix B tortoise with the correct paper work appendix A you need a license. Testudo graeca graeca, Testudo hermanni hermanni.are B I once went to  a vet and as I wanted six tortoises micro chipping which has to be done once they reach ten centimeters.I was asked why do I want to do that, after telling him the law he said that he would look into it.I would be very carefull from who I buy off.

I thought it might be, that is why I wondered if it was part of a scheme to release them into the wild, I can't remember the house owner saying one way or another but they were showing them to visitors.

Important to note:

The local species here, Testudo graeca graeca, is fully protected by law and cannot be sold. Very, very heavy penalties for trading in and illegal possession of these. The other species that occurs in Northern Spain is Testudo hermanni hermanni. That is also protected.

There are other (imported) species, but not all would do well in this climate. In addition, many pet store animals are in very poor condition, and pet shop advice is notoriously diabolical. Strongly advise taking expert advice from real specialists before deciding what to do.  These forums offer reliable and expert advice:

They may have one in Commercial Carmona in Olula del Rio or they may be able to get one for you, they have a large pet place there.
